Department Of Energy Assistant General Counsel for Finance and Information Law in Washington, District Of Columbia

Responsibilities Position is Remote (Restricted)- The duty station can be the employees' home, however, must be located within the local commuting area of Washington, DC which has been established as 125 miles or 2.5 hours. The applicant would not be required to report to the DOE Worksite every pay period but will be required to do so with some regularity (e.g., a few times a month) for work that cannot be performed remotely. The Department of Energy's (DOE) Office of the General Counsel is looking for a dynamic, innovative, seasoned executive to lead and provide legal support and services for DOE on fiscal law, information law, property (real and personal) law, and crosscutting matters, including specifically matters of general law. As the Assistant General Counsel for Finance and Information Law you will: Serve as the program counsel for the Energy Information Administration and the offices of the Chief Financial Officer, the Chief Information Officer (records matters only), Management (non-procurement matters), and Public Affairs. Provide legal support and review of DOE directives and proposed legislation. Provide general legal services and review in support of DOE program activities. Provide legal support with respect to energy data matters including legal services to the Energy Information Administration, the Paperwork Reduction Act, and review of data collection forms. Provide legal support and review of DOE fiscal and budgetary activities. Coordinate the Office of General Counsel's handling of legal issues in matters relating to budgeting, reprogramming and budget control, as well as providing legal advice and assistance in all other fiscal matters. Provide legal support and review with respect to real and personal property matters. Draft and interprets DOE Freedom of Information Act (FOIA) and Privacy Act regulations and provides legal advice and assistance to all headquarters and field divisions and offices on FOIA and Privacy Act matters. Provide legal services and review in connection with all DOE FOIA, Privacy Act, and Paperwork Reduction Act matters including legal review of responses to requests thereunder that are processed at HQ. Serve as a principal contact with the Department of Justice on FOIA litigation. Requirements Conditions of Employment CONDITIONS OF EMPLOYMENT FOR THIS VACANCY: This is a career position in the SES. Unless you are already a member of the SES with career status or have successfully completed an SES Candidate Development Program certified by OPM, your executive qualifications must be approved by OPM before your appointment can be effected. If you are selected, you will be responsible for working with a DOE Executive Consultant to finalize your ECQ narrative for OPM submission. CITIZENSHIP: You must be a U.S. Citizen or National. HOMELAND SECURITY PRESIDENTIAL DIRECTIVE (HSPD-12): Your appointment is contingent upon compliance with Homeland Security Presidential Directive (HSPD-12) governing personal identity. PUBLIC FINANCIAL DISCLOSURE REPORT (OGE 278): If you are selected for this position, will be required to file this report prior to entry on duty in accordance with the Ethics of Government Act of 1978. PROBATIONARY PERIOD: Your initial SES career appointment becomes final only after you successfully complete a one-year probationary period. SECURITY CLEARANCE: You must be able to obtain and maintain a DOE Q-level security clearance DRUG TESTING: As a condition of appointment to this position, you will be subject to pre-employment/pre-appointment testing for illegal drug use under the U.S. Department of Energy Employee Drug Plan. If you are selected you will be provided information regarding drug testing. Failure to undergo testing or positive findings resulting from the test will eliminate you from further consideration for this position. If selected for and appointed to this position you will be subject to random drug testing while employed. Mandatory Technical Qualifications (MTQs) listed later in this section below must be addressed in a separate narrative. EXECUTIVE CORE QUALIFICATIONS (ECQs): The five (5) ECQs described below were designed to assess executive-level experiences and potential not technical expertise. They measure whether you have the broad executive skills needed to succeed in a variety of SES positions. 1: Leading Change: Ability to bring about strategic change, both within and outside the organization, to meet organizational goals and establish an organizational vision and to implement it in a continuously changing environment. 2: Leading People: Ability to lead people toward meeting the organization's vision, mission, and goals and provide an inclusive workplace that fosters the development of others, facilitates cooperation and teamwork, and supports constructive resolution of conflicts. 3: Results Driven: Ability to meet organizational goals and customer expectations, and make decisions that produce high-quality results by applying technical knowledge, analyzing problems, and calculating risks. 4: Business Acumen: Ability to manage human, financial, and information resources strategically. 5: Building Coalitions: Ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals. MANDATORY TECHNICAL QUALIFICATIONS (MTQs): As part of your application package, a supplemental narrative must be uploaded addressing each MTQ listed below. No more than one (1) page per MTQ is allowed; additional informational information will not be considered. MTQs must provide specific examples that address relevant experience and accomplishments. You must reflect superior technical qualifications demonstrated through leadership and management in the following MTQs. Failure to submit a narrative statement addressing each of the MTQs may cause your application to be deemed incomplete and not be considered. MTQ 1: Describe your experience providing advice and counsel to programmatic elements, directly and by overseeing other attorneys, by serving as program counsel and providing general legal services and review in support of programmatic policies, directives, and activities for Cabinet-level departmental elements including: the Chief Financial Officer, Chief Information Officer, and the Chief Administrative/Management Officer (or equivalents). MTQ 2: Describe your experience providing legal advice and counsel, directly and by overseeing other attorneys, regarding federal information law, including the Paperwork Reduction Act, review of data collection forms, Freedom of Information Act (FOIA) and Privacy Act (including legal review of responses to requests thereunder), liaising with Department of Justice on FOIA litigation, and responding to federal data breaches, including loss of personally identifiable information. MTQ 3: Describe your experience providing and overseeing legal support and review of DOE fiscal and budgetary activities, including Departmental matters relating to appropriations, budgeting, reprogramming and budget control, as well as providing legal advice and assistance in all other fiscal matters. Education Must meet the minimum education requirements of successful completion of a full course of study in a school of law accredited by the American Bar Association (ABA) with a professional law degree (L.L.B or J.D.). You must provide a copy of your transcripts from an accredited institution. Be sure to include those transcripts directly applicable to determining your meeting the education requirements. Failure to provide proof of education will result in non-consideration for this position.
